Minimum fees for the maintenance of water supply and sewage collection services

Abstract

The present study seeks to answer two basic questions, namely: i) whether it is lawful, based on the Brazilian sanitation legislation and on the precepts of Administrative Law, to establish the minimum tariff for the maintenance of water supply and sewage collection services and (ii) if water and sewage services tariffs are linked to consumer legislation, which provides for charging the user only for the service actually used or if special rules can rule out such provisions.
