Abstract

The doubts and concerns about regulatory activity still seem to be “anesthetized” by the importance and priority that the subject revealed in the reform of the Code of Administrative Procedure. Nevertheless, we found that one has disregarded a deeper discussion on the regulatory power that is recognized to be vested in regulators and which, without any exception, was transferred from the previous la on that basis, and following that legislative option, we think that we should reflect on this old question in the light of a new response: a new code of administrative procedure. A new code, the same solution?
