Abstract

This article seeks to demonstrate that knowledge of law depends on interpretation, but to arrive at the product of understanding prescriptive statements, the interpreter is dependent on his pre-understanding, that forms logically structured judgments. Such considerations give rise to the perception that the legal norm, in its strict sense, is not previously given by legal texts, but is dependent on the construction by the interpreter, in a path that grants it meaning. In these terms, using the methods of bibliographical and hermeneutic-analytic research, concretized by the empirical-dialectical movement, we seek to explain the interference of the interpretation of the legal norm in the legal relations related to the scope of Administrative Law.
